01Definitions
In this Agreement, the following terms have the meanings set out below:
- Agreement: this Driver Partner Agreement, including any schedules or amendments.
- Akcessible / Drift / we / us: Akcessible Technologies Limited, operator of the Drift platform.
- Driver / Operator / you: the independent individual or entity registered to provide transport services to riders.
- Platform: the Drift mobile application, web portal, dispatch system, and associated technology.
- Rider: a person who requests transport services through the Platform.
- Trip: a journey booked through the Platform and completed by the Operator.
- Fare: the amount charged to a Rider for a Trip, per the applicable LATRA-compliant fare structure.
- Commission: the service fee deducted by Akcessible from the Fare (Section 7).
- Subscription Fee: the recurring platform access fee under the Subscription Model (Section 7).
- LATRA: the Land Transport Regulatory Authority of Tanzania.
- PDPA: the Personal Data Protection Act No. 11 of 2022 of Tanzania.
02Independent contractor status
The Operator is an independent contractor and not an employee, agent, partner, joint-venturer, or representative of Akcessible. This Agreement does not create an employment relationship, a labour relationship, or a partnership of any kind.
No employment rights
As an independent contractor, the Operator is not entitled to employment benefits, including:
- Salary, wages, or guaranteed income.
- Annual leave, sick leave, or public-holiday pay.
- Pension, provident fund, or retirement contributions.
- Workers' compensation or employment injury benefits.
- Health insurance or medical cover provided by Akcessible.
- Notice pay or severance pay upon termination.
The Operator retains full control over when, where, and how they provide transport services, subject to this Agreement, applicable law, and LATRA regulations, and is free to use other platforms. Akcessible does not guarantee a minimum number of trips, minimum earnings, or exclusivity. The transport contract for each Trip is formed directly between the Operator and the Rider; Akcessible is not a party to it and is not a transport carrier.
03Eligibility & onboarding
To register and operate as a driver, the Operator must at all times:
- Be at least 21 years old.
- Hold a valid driving licence appropriate to the vehicle category (Bodaboda, Bajaj, or Car).
- Hold a valid LATRA private-hire licence or authorisation for that category.
- Hold a valid NIDA number or other accepted government identification.
- Own or have lawful authority to operate the vehicle used for Trips.
- Hold valid motor insurance as required by Tanzanian law.
- Maintain a roadworthy, registered, clean, safe, LATRA-compliant vehicle.
- Not have been convicted of a disqualifying criminal offence.
Onboarding may include submission of identification, NIDA, licence, LATRA authorisation, vehicle documents, proof of insurance, a profile photograph, identity verification (which may include biometric verification), and any required training. Akcessible may decline an application at its discretion. The Operator warrants all information is accurate and must notify Akcessible promptly of any change. Akcessible may require periodic reverification; failure to cooperate may result in suspension or termination.
04LATRA compliance obligations
The Operator is solely responsible for obtaining and maintaining all licences, permits, and authorisations required by LATRA and any other authority to provide private-hire transport in Tanzania, including the applicable LATRA private-hire licence, valid vehicle registration, a current roadworthiness certificate where required, and any permit or sticker required to be displayed on the vehicle.
The Operator agrees to accept fares calculated by the Platform per the applicable LATRA fare structure and may not charge Riders amounts above or outside that fare. The Operator must comply with any changes to LATRA requirements. Access to the Platform is contingent on Akcessible maintaining its own LATRA platform licence.
05Insurance obligations
The Operator is solely responsible for maintaining valid and adequate insurance for the vehicle and the transport services provided, including at minimum the motor insurance required by Tanzanian law (which may include third-party liability, passenger liability where required, and comprehensive cover where required or elected).
Akcessible does not provide, underwrite, or arrange motor or passenger insurance, and the Operator must not represent otherwise. The Operator must provide proof of insurance at onboarding and each reverification. If insurance lapses or becomes invalid, the Operator must immediately cease accepting Trips and notify Akcessible. The Operator manages any insurance claim with their own insurer.
06Platform access & use
Akcessible grants the Operator a limited, non-exclusive, non-transferable, revocable licence to use the Platform solely to receive and complete Trips. The Operator is responsible for account security and must not share login details or use another Operator's account. The Operator is responsible for a compatible device and connectivity and agrees to install required updates. The Operator may not:
- Create fake trips or manipulate trip data.
- Generate artificial earnings, incentives, or bonuses through collusive, automated, or deceptive means.
- Solicit cash payments outside approved methods where electronic payment is required.
- Carry unauthorised passengers during Trips.
- Engage in any activity that violates applicable law or the Trust & Safety Framework.
- Reverse-engineer, copy, or interfere with the Platform or its systems.
07Commercial terms
The Platform calculates Fares based on distance, time, applicable surcharges, and other components per the current LATRA-compliant fare structure. The Fare shown at booking is the applicable Fare for that Trip.
Commission Model
Akcessible deducts a platform service commission from the Fare for each completed Trip. The applicable rate is communicated at onboarding and is set in compliance with the maximum permitted by the applicable LATRA order. Net earnings are the Fare minus commission and any other disclosed deductions.
Subscription Model
Alternatively, the Operator may pay a recurring Subscription Fee to access the Platform and retain Trip earnings subject to applicable fees, taxes, and disclosed deductions. Subscription Fees are non-transferable. Where a subscription expires, is cancelled, or remains unpaid, the Operator may be automatically transitioned to the Commission Model without interruption of service, and commissions apply to Trips completed during any lapsed period. Renewal does not reverse commissions charged during a lapse.
Akcessible or its payment provider facilitates payouts through approved channels; payouts may be withheld where fraud, disputes, chargebacks, or regulatory concerns are under investigation, and earnings from policy violations may be withheld, adjusted, reversed, or forfeited. The Operator can access records of earnings, commissions, subscription charges, and payouts. Akcessible may change commercial terms on reasonable notice; continued use constitutes acceptance. Billing disputes may be raised through official support channels.
08Tax obligations
The Operator is solely responsible for determining and fulfilling all tax obligations arising from their activities, including income tax, applicable VAT or withholding taxes, the Skills and Development Levy or other statutory contributions where applicable, and any other obligation imposed by the Tanzania Revenue Authority (TRA). Unless required by law, Akcessible does not withhold income tax or social security on the Operator's behalf, though it may withhold or remit amounts required by law, disclosing any such amount.
09Driver warranties & conduct
The Operator warrants, on an ongoing basis, that all information is accurate; that they hold all required LATRA and other licences; that the vehicle is roadworthy, registered, insured, and compliant; that they have legal capacity; that they will comply with all laws and the Trust & Safety Framework; and that they have no disqualifying criminal history.
Professional conduct
The Operator must treat Riders with respect, follow traffic laws, avoid distracted driving, never drive under the influence, maintain reasonable attire and hygiene, keep the vehicle clean and safe, complete Trips honestly on the agreed route, and display any required LATRA permit.
Prohibited conduct
The Operator must not harass, discriminate against, threaten, or abuse any person; engage in sexual misconduct; stage fake Riders; carry unauthorised passengers; solicit off-platform cash where electronic payment is required; share accounts; provide false information; endanger safety; or engage in criminal activity. Any accident, incident, complaint, or regulatory notice must be reported promptly.
10Suspension
Akcessible may temporarily suspend access, with or without prior notice, during investigations; where a licence, authorisation, or insurance has lapsed; for failed reverification; on reasonable suspicion of a material breach; at the request of authorities; or where suspicious activity is detected. During suspension the Operator cannot accept Trips and payouts may be withheld where fraud or a material dispute is under investigation. Suspension is not automatically termination, and access is restored where a suspension is lifted following investigation.
11Termination
The Operator may terminate at any time by ceasing to use the Platform and notifying Akcessible; outstanding payouts are processed in the normal course subject to holds. Akcessible may terminate on reasonable notice (for example, discontinuing the service in an area or unsupported licence categories) and may terminate immediately and without notice for serious misconduct, including violence, sexual misconduct, criminal conduct, fraudulent documents, fake-trip or payment fraud, account sharing, permanent LATRA revocation, repeated material breach, or an immediate safety risk.
On termination, access is revoked and legitimate earnings paid out in the normal course subject to amounts owed and holds. Sections 2, 8, 12, 13, 14, and 15 survive termination.
12Dispute resolution & appeals
The Operator should first contact Drift Support to resolve any dispute. Appeals against a suspension, termination, earnings adjustment, or enforcement action may be submitted to the Drift Trust & Safety team with relevant details and evidence; appeals are reviewed independently of the original decision-maker where practicable, and the outcome is final for internal purposes. Nothing prevents the Operator from complaining to LATRA or another regulator. This Agreement is governed by the laws of the United Republic of Tanzania, subject to the exclusive jurisdiction of the Tanzanian courts.
13Liability
The Operator is solely liable for any loss, damage, injury, or claim arising from the transport services they provide. To the maximum extent permitted by Tanzanian law, Akcessible's liability under this Agreement is limited to the net earnings paid to the Operator in the 30-day period immediately preceding the event giving rise to the claim, and Akcessible is not liable for loss of earnings, opportunity, or indirect or consequential loss. Akcessible does not guarantee uninterrupted availability and is not liable for failures attributable to third-party providers.
14Confidentiality
The Operator agrees to keep confidential any non-public information about the Platform, Akcessible's technology, commercial terms, or operational procedures, except where information is public, already known to the Operator, or required to be disclosed by law or a regulator.
15Data protection
Akcessible processes the Operator's personal data as a data controller under the PDPA to operate the Platform, verify the Operator, process payments, ensure safety, and comply with the law. Full details are in the Drift Privacy Policy. Limited Operator information (first name, vehicle details, photograph, and approximate location during a Trip) is shared with Riders to facilitate Trips, and data may be shared with LATRA, law enforcement, or regulators where required. The Operator must handle any Rider personal data strictly to complete the Trip and must not retain, copy, share, or use it for any other purpose.
16General
This Agreement, together with the Trust & Safety Framework, the Drift Privacy Policy, and the Drift Terms of Service, constitutes the entire agreement between the parties and supersedes prior agreements. Akcessible may amend it on reasonable notice; continued use constitutes acceptance. If any provision is invalid it will be modified or severed without affecting the rest. No failure to exercise a right is a waiver. The Operator may not assign this Agreement without consent; Akcessible may assign it to a successor entity. Neither party is liable for failures caused by force-majeure events. This Agreement is written in English, which prevails over any translation.
17Acceptance & electronic consent
This Agreement is accepted electronically. During onboarding the Operator confirms acceptance by ticking an acceptance checkbox and tapping “Activate Account” or equivalent; the button is disabled until the checkbox is selected. The acceptance screen displays the following or substantially similar language:
“I have read and understood the Drift Driver Partner Agreement, Privacy Policy, and Community Standards. I agree to be bound by their terms and confirm that I meet the eligibility requirements to operate as a driver on the Drift platform.”
By accepting electronically, the Operator confirms they have read and understood the Agreement, agree to be bound, have legal capacity, and meet the eligibility requirements, and acknowledges that electronic acceptance is as legally binding as a handwritten signature under the Electronic Transactions Act, 2015 of Tanzania.
Akcessible maintains a secure, timestamped record of each acceptance (account identifier, agreement version such as DPA-v1.0, date and time, device identifier and IP address, and a reference to the agreement text in force). Each version is published at a permanent URL (this page is https://nowdrift.com/legal/dpa/v1). When the Agreement is materially updated, existing Operators are prompted to review and re-accept before continuing. An Operator who does not wish to accept an updated version may terminate their account before it takes effect.
